I currently am paying medical aid for myself, wife and child however I am not the main member, it is my wife, I currently deposit funds into her account for the deductions. She is currently unemployed and does not claim for tax. This was the only way to come off the company medical aid as they were too expensive
I wanted to know if I can claim this as I am paying for the medical aid just that its not on my name, I am the dependent and she is the main member. Further more we are married by custom marriage so we are not registered and she does not carry my surname but my child does. Will I still be able to claim for this from SARS even though the tax certificate is on her name.
SARS can be quite strict with this, however if you are paying medical aid for a dependent who is unemployed you should be able to claim the medical credit in your own tax return. If SARS does require proof, you would need to submit the medical aid certificate with an explanation as to why the surname is different (i.e. document/affidavit proving your customary marriage) and also an explanation that you are paying the medical aid for your dependents. It might be easier to actually go to SARS with these documents and speak to a consultant if required.
