Terms and Conditions of Use


Definitions

  1. The following terms will be assigned the following meanings when used in these Terms:
    1. "ECT Act" means the Electronic Communications and Transactions Act 25 of 2002;
    2. "Human Robot" means Human Robot (Proprietary) Limited trading as "TaxTim", the proprietor of the Website;
    3. "Intellectual Property" means all patents, trademarks, designs, logos, trade or business names, trade secrets, know-how, and copyright or any changes or additions thereto (if any), whether or not registerable, registered or application for registration of any such rights has been made in any country;
    4. "Income Tax Act" means the South African Income Tax Act, No. 58 of 1962;
    5. "Law" means all applicable laws of the Republic of South Africa, including the Constitution, Acts of Parliament, subordinate legislation, regulations, rules, directives, notices, common law, and any binding orders or decisions of a court or competent governmental or regulatory authority, including SARS, as amended or replaced from time to time.
    6. "the Website" means the website located at http://www.taxtim.com , https://www.taxtim.com, http://www.taxtim.co.za and all content found therein, including but not limited to any text, images, computer programs, software code, metadata, databases, graphic design elements and all other materials accessible through the website, but expressly excluding links to external third party websites;
    7. "Party/ies" means Human Robot and the User, or any one of them as the context indicates;
    8. "SARS" means the South African Revenue Service;
    9. "Service" means any tax-related or finance-related service, including any related financial services, offered by Human Robot through the Website, from time to time, and a reference to "Services" shall mean any combination of such services as the context may indicate;
    10. "Tax Administration Act" means the Tax Administration Act, No. 28 of 2011;
    11. "Tax Return" means tax return forms ITR12, IRP6 and ITR14, and any other tax return form that may apply from time to time based on the Services offered by Human Robot;
    12. "Tax Practitioner" means any tax practitioner engaged by Human Robot to provide electronic feedback contemplated in clause 15;
    13. "Terms" means these terms and conditions, and expressly includes any annexures;
    14. "T-filing" means the service offered by Human Robot whereby the company electronically submits the Tax Returns of a User to the South African Revenue Service via the Human Robot website;
    15. "TimAI" means TaxTim's proprietary artificial intelligence tax assistant, made available by Human Robot to Users through the Website and/or third-party communication platforms (including WhatsApp), which may assist Users by answering tax-related questions, explaining tax rules, performing calculations, identifying possible supporting documents, and flagging issues that may require further review;
    16. "User" means -
      any person accessing any part of the Website, including the home page; or
      any person that has registered with Human Robot through the Website in order to use Services, and a reference to "you" means you in your capacity as a User.
  2. The clause headings in these Terms have been inserted for purposes of convenience only and will not be taken into consideration in its interpretation;
  3. Any reference to:
    1. the singular includes the plural and vice versa;
    2. any gender includes the other genders; and
    3. a natural person includes a juristic person and vice versa.
  4. Any reference to "days" means calendar days, unless expressly stipulated otherwise, and any time period prescribed in these Terms will be calculated by excluding the first and including the last day of that period.
  5. The word "including" means "including without limitation". The use of the word "including" followed by a specific example/s will not be construed as limiting the meaning of the general wording preceding it.
  6. Expressions defined in these Terms shall bear the same meanings in schedules or annexures to these Terms which do not themselves contain their own conflicting definitions.


  7. PART 1 – USE OF THE WEBSITE

    Binding agreement

  8. By accessing and using the Website, the User agrees to be bound by these Terms, including any privacy, acceptable use or other policies which are published on the Website from time to time. If you do not agree to be bound by these Terms, you must leave the Website immediately. If you don't, your continued use of the Website will be inferred to be a statement of your intent to be bound by these Terms as per section 24 of the ECT Act.
  9. By registering an account, purchasing a Service or clicking to accept these Terms, you agree to be bound by them, including the Privacy Policy and any service-specific terms presented to you. If you merely browse the public pages of the Website, the provisions of Part 1 apply to that browsing.
  10. If you do not agree to these Terms, you may not register an account or use any Service, and you should stop using the Website immediately. Certain clauses limit our liability, require you to give indemnities or authorise specific actions, these are highlighted in bold and drawn to your attention before you accept these Terms, as required by section 49 of the Consumer Protection Act 68 of 2008.

  12. Use of the Website

  13. The User agrees that the User will not utilise the Website or any Service to:
    1. upload, post or otherwise transmit any content that is unlawful, harmful, abusive, defamatory, obscene or otherwise objectionable or constitutes harassment or hate speech, or which is invasive of the privacy of another;
    2. impersonate any person connected to the Website or any Service or otherwise misrepresent their association with any such person;
    3. take any steps to disguise the origin of any communications or content;
    4. take any steps to restrict access to any part of the Website;
    5. upload, post or otherwise transmit any content that infringes the intellectual property rights of a third party or which the User is restricted from uploading, posting or otherwise transmitting by operation of law, contract or duty of care;
    6. use the Website or any Service to engage in any unsolicited, unlawful or unauthorised marketing, advertising or promotional activities, including but not limited to the harvesting of addresses and the sending of spam and chain letters;
    7. upload, post or otherwise transmit any content that contains any malicious code which is designed to or will have the effect of disrupting in any way and to any degree the operation of the Website or any Service, and of any software, hardware or electronic communications equipment on which it relies for its operation;
    8. collect and / or store data on any other User or Users;
    9. engage in any commercial activity on or through the Website without the prior written consent of Human Robot.
  14. The User may not use TimAI or the TaxTim Service to hide income, fabricate documents, backdate facts, misrepresent information to SARS, evade tax, avoid lawful tax obligations, or otherwise act unlawfully.
  15. Human Robot may refuse assistance, restrict access, suspend access or escalate the matter where Human Robot reasonably believes that the Website, any Service or TimAI is being used for an unlawful or improper purpose.

  16. No offer

  17. The User should regard nothing contained on the Website as an offer, but rather as an invitation to do business.

  18. User's rights under the ECT Act

  19. The purchase and sale of any Services may be classified as "an electronic transaction" for the purposes of the ECT Act. Users, who are consumers for the purposes of Chapter 7 of the ECT Act, enjoy certain rights in relation to such electronic transactions which are set out below.
  20. Human Robot is required in terms of section 43(1) of the ECT to provide Users with the following information:

    13. Membership of any self regulatory or accreditation bodies: -
    14. Applicable code/s of conduct: Each Tax Practitioner will be (1) registered -
      1. as a "registered tax practitioner" in terms of the Tax Administration Act; and
      2. as a Chartered Accountant with the South African Institute of Chartered Accountants;
  21. Where you conclude an electronic transaction to which section 44 of the ECT Act applies, you may cancel it within 7 days after conclusion of the agreement without reason or penalty, in which case any payment will be refunded within 30 days. The cooling-off right does not apply where an exclusion in section 42(2) of the ECT Act applies, in particular, once performance of the Service has begun with your consent (including but not limited to, once you begin completing your Tax Return or TimAI begins assisting you with it).

  22. Security and monitoring

  23. While Human Robot takes all reasonable security precautions to protect the accessibility and integrity of the Website and all content contained therein, Human Robot will not be liable for any damage caused by the malicious use of the Website or by the introduction or downloading of any harmful or destructive data or code that is passed on to the User through the User's use of the Website.
  24. The User agrees that the User will not undertake any of the following acts:
    1. Gaining or attempting to gain unauthorised access to the Website or any part thereof;
    2. Intercepting or attempting to intercept any data contained in or transmitted to or from the Website without authority or permission to do so;
    3. Interfering or attempting to interfere with any data contained in or transmitted to or from the Website without authority or permission to do so;
    4. Using or attempting to use any device, including a computer program or a component designed primarily to overcome any security measures for the protection of data, to overcome any security measures used by Human Robot in relation to the Website;
    5. Interfering with the access of others to the Website which constitutes a denial, or partial denial of service to such persons;
    6. Delivering or attempting to deliver any unauthorised or malicious code or content to the Website; and/or
  25. There is no general obligation on Human Robot to monitor any data which is transmitted or stored via the Website; or to actively seek facts or circumstances which may indicate any unlawful activity. However, in order to provide secure Services and where required to do so under law, Human Robot may monitor and/or intercept electronic communications which are sent and received by the Website solely for the purposes of securing the Website and Services, preventing fraud and abuse, complying with law, and maintaining service quality, and in accordance with the Privacy Policy and applicable law, including RICA and POPIA. The User hereby acknowledges that they are aware of such potential monitoring and/or interception and they expressly and voluntarily consent thereto.

  26. Intellectual Property Rights

  27. Subject to clause 8, all right, title and interest in and to the Intellectual Property is owned by or licensed to Human Robot. The User unconditionally and irrevocably agrees that under no circumstances will it acquire any right, title or interest to the Intellectual Property and nor will it assert any claim in this regard.
  28. The User acknowledges that the Website contains links to third party advertising and material. Accordingly, the User agrees that all Intellectual Property in any third party advertisements or material vests in or is licensed to the relevant third-parties.
  29. The "TaxTim" name and logo are trademarks owned by Human Robot and may not be used by the User in any manner under any circumstances, without the express prior written permission of Human Robot.
  30. The User shall not, under any circumstances and at any time, remove, amend, alter, copy, exploit or otherwise deal with any Intellectual Property relating to the Website or any Service.

  31. Advertising, sponsorship and social media

  32. The Website may contain third party advertising or material from time to time. Human Robot will not be responsible or liability for any error or inaccuracy appearing in any third party advertisement which appears on the Website.
  33. The User acknowledges and agrees that Human Robot does not necessarily endorse or support any product or service that may be advertised in any third party advertisements or material that may appear on the Website from time to time.
  34. The User acknowledges and agrees that Human Robot is not be liable for the content of any material posted or made available on any social media platform or blog which may be displayed on or linked to the Website from time to time.

  35. Cookies

  36. In order to improve our Services, Human Robot may use a "cookie" and/or other similar files or programs which may place certain information on your device's hard drive when you visit the Website. A cookie is a small amount of data that our web server sends to your web browser when you visit certain parts of the Website.
  37. Human Robot may use cookies to:
    1. allow Human Robot to recognise your device when you return to the Website so that Human Robot can understand your interest in the Website and tailor its content and advertisements to match your interests (This type of cookie may be stored permanently on your device but does not contain any information that can identify you personally);
    2. identify you after you have logged in by storing a temporary reference number in the cookie so that our web server can conduct a dialogue with you while simultaneously dealing with other customers (your browser keeps this type of cookie until you log off or close down your browser when these types of cookie are normally deleted. No other information is stored in this type of cookie);
    3. allow you to carry information across pages of the Website and avoid having to re-enter that information;
    4. allow you access to stored information if you register for any of our Services;
    5. enable us to produce statistical information (anonymous) which helps us to improve the structure and content of the Website; and
    6. enable us to evaluate the effectiveness of our advertising and promotions.
  38. Cookies do not enable us to gather personal information about you unless you give the information to our server. Most internet browser software allows the blocking of all cookies or enables you to receive a warning before a cookie is stored. For further information, please refer to your Internet browser software instructions or help screen. Alternatively, information on deleting or controlling cookies is available at http://www.allaboutcookies.org.

  39. Search technology

  40. Human Robot provides search functionality on the Website. However, Human Robot does not warrant that such functionality will always be suitable, available and/or accurate, and it does not accept liability for any inconvenience, loss or harm that may be caused to any party as a result of the search functionality of the Website not being suitable, available and/or accurate.
  41. No technology or applications may be used to perform automated searches of the Website and its content, including the use of web crawlers or web spiders, without the express, prior written permission from Human Robot, unless used for the performance of its services by a legitimate search engine operator.
  42. The use of search technology in an unlawful manner, or for the collecting or harvesting of data for commercial gain, or which obstructs the efficient operation of the Website is strictly prohibited.

  43. Hyperlinks, deep links & framing

  44. Permission to link to the Website is given without assumption of any liability on the part of Human Robot. Human Robot reserves the right to withdraw such permission at any time and for any reason.
  45. Hyperlinks, whether in the form of text, images or banner advertising, contained in the Website and directed towards third party websites are provided without any warranties or endorsements as to the content, suitability, accuracy or security of the third party websites linked to. The Website does not control and/or edit the content of the third party websites or pages linked to, and Human Robot disclaims all liability, direct or indirect, which may arise from the use or inability to use a link or a linked-to website. Use of the third party websites or pages linked to is exclusively at the risk of the User.
  46. Express, prior written permission from Human Robot, which may be subject to any further terms and conditions that it deems fit, is required before the Website, any of its pages and/or any of the content contained therein is framed. Requests for permission can be submitted to .

  47. Termination of access to the Website

  48. Human Robot may in its sole and absolute discretion suspend or terminate a User's access immediately and without prior notice for any reason whatsoever including but not limited to where the User breaches these Terms, uses the Website or any Service unlawfully, or where suspension is required by law or to protect the security of the Website or other Users.


  49. PART 2 – USE OF SERVICES

    Privacy and Confidentiality of Communications

  50. Human Robot may collect personal information about you from time to time to enable it to perform and provide the Services.
  51. Human Robot will process and disclose your personal information only with your written consent as described in the Privacy Policy including to operators and service providers acting on its behalf, to SARS where you use the T-filing service, where required or permitted by law, or otherwise on a lawful ground under POPIA. In the event of any conflict between these Terms and the Privacy Policy concerning personal information, the Privacy Policy prevails.
  52. Human Robot will not disclose your personal information to any third parties who are not involved in the performance of the Services unless you have given your written consent for it to do so.
  53. Human Robot respects the privacy of Users' personal information. Further information in this regard is contained in its Privacy Policy.
  54. TimAI may process personal information as described in TaxTim's Privacy Policy. The use of TimAI is subject to TaxTim's Privacy Policy, including any provisions dealing with AI processing, service providers, cross-border processing, retention and security.
  55. Users should not enter personal information into TimAI that is not relevant to their tax question.
  56. Human Robot will send you service and transactional communications (for example, messages about your Tax Return, payments and deadlines) using the contact details you provide. Marketing communications, including newsletters, will only be sent in accordance with section 69 of POPIA: where you have consented, or where you are an existing customer and were given the opportunity to object when your details were collected. Every marketing communication will contain an unsubscribe mechanism, and you may opt out at any time without charge.
  57. If you wish to unsubscribe from any mailing list administered by Human Robot, either make use of the unsubscribe link provided, or write into the TaxTim Helpdesk (https://www.taxtim.com/za/troubleshoot) to request removal.

  58. Registration

  59. In order to access any Service, User's must register an account with Human Robot.
  60. When registering an account, User's agree that:
    1. they will provide full and accurate information when required, including a username and password;
    2. registration is for a single User and a User's username and password cannot be shared with any other person or be used to allow multiple access to other Users over a network;
    3. they will not impersonate or attempt to impersonate any other person or use any false names or details when registering; and
    4. they will frequently check and update the information pertaining to their registration.

  61. Nature of Services

  62. In performing the Services, Human Robot provides electronic feedback and information through the Website, SMS or via email to the User. The electronic feedback referred to in this clause 15 is in the form of either -
    1. pre-programmed automated responses that depend on inputs from the User in using the Service; or
    2. responses generated by a Tax Practitioner in response to queries received from Users in using the Service; or
    3. responses generated by SARS in response to activity related to Users in using SARS or the Service.
  63. The User acknowledges and agrees that the electronic feedback and information referred to herein and received by the User shall not, under any circumstances, be construed by the User as formal tax advice given by Human Robot and/or any Tax Practitioner, in relation to the personal affairs of the User or otherwise, except where the Services provided are in the form of a Tax Return submission to the South African Revenue Service submitted by Human Robot via the T-filing service and where the User has engaged with one of Human Robot's tax practitioners.
  64. The User shall be entitled to engage a Tax Practitioner to perform tax-related services (whether in relation to any Service or not) for the User by contacting Human Robot and requesting to speak to a Tax Advisor. Any such engagement shall be on terms agreed between the User and the relevant Tax Practitioner.
  65. In performing the Services, except for those listed under the definition of T-filing, Human Robot will not, at any time and under any circumstances, engage with SARS on your behalf, whether directly or indirectly.
  66. No Tax Return will be submitted under the T-filing service without your confirmation of the completed return (through the use of the Submit to SARS (or similar) button or in writing to one of our practitioners). Ultimately the User remains responsible for the submission and contents of the Tax Return.
  67. The User acknowledges that Human Robot does not operate a telephone call center and does not make outbound phonecalls at any time. All customer support and communication takes place via the online electronic helpdesk, outbound SMS, email and/or social channels.

  68. TimAI

  69. Human Robot may make TimAI available to Users as part of the Services. TimAI is designed to assist Users with tax-related questions and to support Users while completing, reviewing or understanding their tax information. It is expressly not intended to replace the advice of a Tax Practitioner and Users should at all times seek confirmation of any material facts with our Tax Practitioners before taking action that may impact the user's Tax Return.
  70. TimAI may use information from the User's TaxTim profile, tax return, prior returns, uploaded documents and chat interactions, where available, in order to provide relevant responses.
  71. TimAI may explain South African tax rules, apply those rules to the information available to it, perform calculations, identify possible supporting documents, and flag matters that may require further review.
  72. Responses generated by TimAI constitute automated electronic feedback and do not constitute formal tax advice given by Human Robot and/or any Tax Practitioner. TimAI may recommend human practitioner review where a matter is complex, fact-dependent, high-value, SARS-sensitive, outside TimAI's scope, or requires a professional judgment on the User's specific facts.
  73. Human Robot may require a User to engage with a human practitioner before Human Robot provides further assistance on certain matters.
  74. Human Robot may also decline to allow TimAI to answer or complete a request where the request is unlawful, abusive, outside scope, requires Human Robot to act on the User's behalf, or requires a professional judgment that TimAI should not make.
  75. The User acknowledges that any recommendation by TimAI to seek advice from a qualified tax practitioner forms part of TimAI's risk management process. The User further acknowledges that where they choose to disregard such a recommendation, they do so voluntarily and at their own risk, and TimAI shall not be liable for any loss, damage, penalties, interest, or other consequences that could reasonably have been avoided had the recommended professional advice been obtained, except to the extent that such exclusion of liability is prohibited by applicable law.

  76. TimAI on WhatsApp and other third-party platforms

  77. Where TimAI is made available through WhatsApp or another third-party communication platform, the User's use of that platform is also subject to the terms, privacy and other internal policies and security practices of that third-party platform.
  78. Users should not send information through WhatsApp or another third-party platform unless they are comfortable using that channel for tax-related communication.
  79. Human Robot may limit what TimAI can do through WhatsApp compared with the logged-in TaxTim platform.
  80. Human Robot may require the User to move from WhatsApp to the logged-in TaxTim platform or to a human support channel where the matter requires access to the User's return, supporting documents, identity verification, payment, practitioner review or another higher-risk interaction.

  81. Modification and Termination of Services

  82. The User acknowledges and agrees that Human Robot may, at any time -
    1. add, remove or change any function, characteristic or feature of any Service for any reason;
    2. suspend or cancel the provision of any Service for any reason.

  83. Payment for Services

  84. Human Robot accepts payments for the Services -
    1. through a credit card or cheque card; or
    2. by way of TaxTim coupon code / voucher; or
    3. by entering a credential related to a loyalty programme; or
    4. by way of electronic funds transfer into the bank account of Human Robot.
  85. If you make payment for any Services by way of electronic funds transfer, please note that -
    1. You must make payment of the full amount for the Services as displayed on the Website;
    2. the reference number for the Services as displayed on the Website;
    3. For purposes of this clause, payment shall only be deemed to have been made on the date and time at which -
      You provide to Human Robot, by way of email, suitable proof of payment of the full amount for the relevant Services as displayed on the Website; and
      The full amount for the Services as displayed on the Website, in South African Rands, clears and is irrevocably released into the bank account of Human Robot within 3 (three) days of the date on which you have initiated the relevant Service.
    Please note that any Services will automatically be cancelled if Human Robot does not receive the payment referred to in clause 19.2 above in its bank account within the stipulated timeframe. For the avoidance of doubt, you shall have no claim of any nature against Human Robot arising, whether directly or indirectly, from such cancellation. If your payment is received after cancellation, Human Robot will, at its sole election, reinstate the Service or refund the amount received in full. Nothing in this clause affects any right you may have to a refund under the Consumer Protection Act.

  86. Unless expressly stated otherwise, all amounts displayed are inclusive of Value-Added Tax ("VAT") at the standard rate of 15%, or such other VAT rate as may be prescribed by applicable South African law from time to time.

    Warranties given by the User

  87. You unconditionally and irrevocably warrant that -
    1. You are a natural person;
    2. You are a "Resident" as defined in the Income Tax Act;
    3. All of the information, documents and data provided by you pursuant to your use of a Service are true, accurate, complete, current and not misleading.
    4. You remain solely responsible for reviewing and verifying all tax returns, submissions, calculations and other outputs generated by the Services before submitting them to SARS or relying on them for any purpose.
    5. Where TaxTim recommends that you obtain advice from a qualified tax practitioner, you will carefully consider that recommendation and acknowledge that any decision to proceed without obtaining such advice is made at your own risk.
    6. You will not use the Services to attempt to circumvent, interfere with or compromise the security, integrity or proper functioning of the platform.


  88. PART 3 – GENERAL

    Disclaimers

  89. The entire Website, including text, images, links, downloads and coding, is provided "as is" and "as available". Human Robot makes no representations or warranties, express or implied, including but not limited to warranties as to the correctness or suitability of either the Website or the information contained in it.
  90. The User agrees that the User's access to and use of the Website, including the downloading of any material from the Website, is at the User's own risk and that the User will be solely responsible for any damage to any information system or loss of data that results from such access and use.
  91. The Services are provided using a commercially reasonable level of skill and care. Other than as expressly set out in these Terms, Human Robot makes no warranties regarding any Service. The Services are provided "as is".

  92. Limitation of liability

  93. All information entered by you is deemed to be information which is true and correct and Human Robot will not be held liable under any circumstances for any errors or omissions in the information as provided by you.
  94. Human Robot will exercise reasonable care and skill in providing the Services and will use reasonable endeavours to prevent errors. Where an error is demonstrated to have arisen solely as a result of Human Robot's fault, Human Robot will, at its own discretion, use reasonable endeavours to correct or remedy the error within a reasonable period. Except as expressly provided otherwise herein and to the maximum extent permitted by applicable law, such correction or remedy shall constitute the Customer's sole and exclusive remedy in respect of such error.
  95. The User hereby confirms and agrees that any content and information contained in the Website has not been compiled to meet the User's individual requirements and that the User is responsible for satisfying themselves that the content and information accessed and used is suited to their own requirements. If they are not so satisfied, their sole and exclusive remedy is to stop accessing and using the Website and/or Services.
  96. Information, ideas and opinions expressed on the Website or pursuant to the provision of any Service do/does not constitute professional advice, or the official opinion of Human Robot, its directors, officers, employees, suppliers, service providers, publishers, partners, affiliates and agents. You are solely responsible for any action that you take based on the information, ideas and opinions expressed in the Website or pursuant to the provision of any Service.
  97. The provision and use of any Service does not create any form of professional relationship between Human Robot and the User nor between any Tax Practitioner and the User.
  98. Use of the TaxTim platform, TimAI, automated tools, help content or general support does not, by itself, create a professional tax-practitioner engagement between the User and Human Robot or any Tax Practitioner.
  99. Where Human Robot or a Tax Practitioner separately agrees to provide a professional tax service, that service may be subject to separate engagement terms, service-specific wording, quotation, payment terms or written confirmation of scope.
  100. Professional tax services may include, for example, objections, disputes, tax opinions, review of supporting documents, tax-directive applications, foreign-investment or emigration-related tax work, or other services where a Tax Practitioner agrees to take responsibility for a specific tax position or process.
  101. Human Robot, its directors, officers, employees, publishers, suppliers, ISPs, partners, affiliates and agents, shall not be liable for any damage, loss, costs, penalties or liability of any nature, howsoever arising, incurred by the User or any other persons, including but not limited to direct, economic, consequential loss or loss of profits, resulting from, whether directly or indirectly -
    1. the use of, or the inability to use, the Website in any manner;
    2. the provision of any Service by Human Robot to a User.
      In particular, but without limitation, Human Robot will not be liable for the following:
      1. providing access to, or transmitting, routing or storing any data messages via the Website, provided that Human Robot did not initiate the transmission, select the addressee, or modify the data contained in the relevant data message and performed its functions in an automatic and technical manner;
      2. the automatic, intermediate and temporary storage of any data transmitted via the Website, where the purpose of storing such data is to make the onward transmission of the data more efficient to others upon their request, provided that Human Robot does not modify the data, complies with conditions and rules on accessing and updating the data, and does not interfere with the lawful use of technology, widely recognised and used in this regard;
      3. the storage of data provided by the User or any other party where Human Robot does not have actual knowledge that the data message or an activity relating to the data message is infringing the rights of another party, or is not aware of facts or circumstances from which the infringing activity or the infringing nature of the data message is apparent;
      4. referring or linking a User to another webpage containing an infringing data message or infringing activity, where Human Robot does not have actual knowledge that the data message or activity relating to the data message is infringing the rights of another party, or is not aware of facts or circumstances from which the infringing activity or the infringing nature of the data message, and it does not receive any financial benefit directly attributable to the infringing activity or data message, and removes the reference or link within a reasonable time after being notified of the infringing activity or data message;
      5. any penalties or charges levied by SARS on a User in relation to the tax affairs of the User.
      6. any use of, or reliance on, TimAI or any response generated by TimAI.
  102. TaxTim is not responsible for any penalties or consequences arising from the late payment of any amounts due in relation to any tax type. This remains the sole responsibility of the User to validate and execute. TaxTim will use its best efforts to inform the User of amounts due, but may be limited in doing so by factors beyond its control, including system outages, eFiling downtime and other technical issues. Furthermore, TaxTim will not be responsible for late tax submissions where a User completes their return on the platform less than 48 (forty-eight) hours (calculated with reference to working days) before the applicable filing deadline. In all circumstances TaxTim will assist on a best-efforts basis; however, as technical eFiling issues frequently arise around deadline periods, TaxTim does not warrant that a return submitted within this period will be filed successfully before the applicable deadline, and TaxTim accepts no liability for any resulting late submission.
  103. TimAI is an artificial intelligence system and may make mistakes. Users are expected to validate any outputs received with our Tax Practitioners before taking action that may have a direct impact on their Tax Return.
  104. TimAI's responses depend on the information available to it and the information provided by the User. A response may be incomplete or incorrect if the User's information is incomplete, inaccurate or not up to date.
  105. Users remain responsible for checking the accuracy and completeness of their tax information before submitting a return, accepting an assessment, making a payment, objecting to an assessment, or otherwise acting on information provided by TimAI.
  106. TimAI does not independently submit tax returns, accept assessments, make payments, object to assessments, communicate with SARS, or make binding decisions on behalf of a User.

  107. Indemnity

  108. The User unconditionally and irrevocably indemnifies Human Robot, its directors, officers, employees, publishers, suppliers, ISPs, servants, sub-contractors, partners, subsidiaries and affiliates from any demand, action or application or other proceedings, including for attorneys fees (on an attorney and own client scale) and related costs made by any third party and arising out of or in connection with, whether directly or indirectly -
    1. the User's use of the Website, third party websites linked to from the Website or any of the content offered through this or any other sites linked to.
    2. the provision of any Services by Human Robot to the User.

  109. Applicable law and jurisdiction

  110. The User hereby agrees that the law applicable to these Terms, their interpretation, and any matter arising from these Terms will be the law of the Republic of South Africa.
  111. The Website is owned, hosted and maintained within the Republic of South Africa.
  112. When using the Website and agreeing to these Terms, you agree that such use and agreement is deemed to have taken place in Cape Town, South Africa.

  113. Dispute resolution

  114. In the event of any dispute or difference arising between the Parties relating to or arising out of these Terms, including the implementation, execution, interpretation, rectification, termination or cancellation of the agreement constituted thereby, the said dispute or difference shall be submitted to arbitration in Cape Town in accordance with the Rules of the Arbitration Foundation of Southern Africa (or any succeeding body) by an arbitrator or arbitrators appointed by the Foundation.
  115. Notwithstanding anything to the contrary contained herein, any party to the arbitration may seek interlocutory relief in any competent court having jurisdiction pending the institution of appropriate proceedings for the enforcement of any rights under this agreement.
  116. The Parties undertake to keep the arbitration, including the subject matter of the arbitration and the evidence heard during the arbitration, confidential and not to disclose it to anyone except for the purposes of an order to be made in the arbitration.
  117. The decision of the arbitrator shall, in the absence of manifest error, be final and binding on the Parties and may be made an order of any competent court in South Africa at the instance of any party.
  118. These provisions are separate and severable from the rest of this agreement and, accordingly, will remain in effect despite the termination or invalidity for any reason of these Terms.

  119. Amendment of these Terms

  120. Human Robot reserves the right, at any time, to amend any of these Terms without any specific notice being given to the User. An updated version of the Terms will be posted on the Website with a new version date and it will be the sole responsibility of the User to check and read the latest version of these Terms when accessing the Website.
  121. If the User objects to any amendment of these Terms, their sole remedy will be to terminate their access and use of the Website.

  122. General provisions

  123. Each term of these Terms is deemed to be separate and severable from each other and if any term or condition contained in these Terms is found by any court of competent jurisdiction to be invalid and/or unenforceable then, notwithstanding such invalidity and/or unenforceability, the remaining terms and conditions will be and remain of full force and effect.
  124. These Terms of use, together with the Privacy Policy, and any other policies published on the Website, constitute the entire agreement between the Parties regarding the access and use of the Website. No other agreements, representations or warranties between the Parties regarding the access and use of the Website other than those set out herein are binding on the Parties.
  125. No latitude, extension of time or other indulgence which may be given or allowed by any party to the other in respect of the performance of any obligation under these Terms will be construed to be an implied consent or election by such party, or operate as a waiver or a novation of, or otherwise affect any of the party's rights in terms of or arising from these Terms.



  126. PART 4 – REFUND POLICY Refunds
    • TaxTim's service fee covers access to our tax preparation platform, guidance, filing options, and helpdesk support. A refund is not automatically granted because a taxpayer chooses not to continue or due to circumstances outside of TaxTim's control affect the filing process.
    Situations Where Refunds Will Not Be Granted

    • TaxTim does not provide refunds in the following circumstances:
      1. The customer is unable to submit a tax return through TaxTim due to circumstances outside TaxTim's control, including:
        1. SARS system outages;
        2. eFiling technical issues;
        3. Delayed SARS integrations;
        4. SARS maintenance or upgrades.
      2. The customer communicates through channels other than the online Help Desk (such as email or social media), resulting in delays in resolving or submitting their return.
      3. The customer makes payment in error or later becomes aware of a promotion, discount, or special offer that was not applied at the time of purchase.
      4. The customer makes payment and subsequently becomes eligible for a partner discount or promotional offer.
      5. More than seven (7) days have passed since payment, and the customer no longer wishes to continue using the service.
      6. SARS requires the customer to complete an action that TaxTim cannot perform on their behalf, including:
        1. Visiting a SARS branch;
        2. Attending a SARS appointment;
        3. Completing SARS eFiling verification processes directly.
      7. The customer utilizes the TaxTim service (through completing or substantially completing a Tax Return; accessing the Helpdesk or utilizing TimAI) but subsequently decides to accept a SARS auto-assessment or estimated assessment.
      8. The customer files through TaxTim after SARS have already issued an auto-assessment or estimated assessment, and the deadline for accepting or rejecting that assessment has passed, resulting in the return being rejected by SARS.
    Circumstances Where a Refund May Be Considered

    • Where reasonable, TaxTim will always seek to be accommodating in considering any refund request.
    • TaxTim will consider providing a refund only where the core services purchased (being the completion of a Tax Return; access to tax support through our helpdesk or TimAI and access to relevant tax related information and tools) have not been rendered or utilised.
    • The preferred remedy is a TaxTim voucher or account credit for future use. If this is not appropriate or acceptable, a refund may be processed back to the original payment method for the amount paid less any attributable transaction charges (approximately 5%).
    • Refund consideration may apply where TaxTim fails to provide one or more of the following services:
      1. The TaxTim platform fails to:
        1. Ask relevant questions regarding income and expenses;
        2. Complete the tax return based on the customer's answers; or
        3. Provide a tax calculation or refund estimate (where applicable to an ITR12 return).
      2. TaxTim is unable to provide any reasonable filing option, including:
        1. Submission through the TaxTim platform;
        2. Submission via SARS eFiling; or
        3. Submission assistance through the Help Desk.



    PART 5 – CANCELLATIONS Cancelling your profile and opting out
    • Should you wish to cancel your registered profile with TaxTim then please contact our team via the Helpdesk to request that your registered account be deleted.
    • Should you wish to longer receive emails from TaxTim, each email contains an unsubscribe button with which to do so.
    • Should you wish to opt out of all reminders and emails, but maintain your registered profile then please log into your TaxTim account and click Profile to adjust contact preferences.
