Am I a provisional taxpayer if I work freelance?

  Written by Marc

I'm a freelance writer earning very little, in fact I might just be over the tax threshold of R58k in the coming year. Do I have to register as a provisional taxpayer and do I have to pay 18% up front for the next tax year? (I've done 2011-2012, I was below the R58k)

Expense boundaries and amounts on section 4016

  Written by Marc

Hi Tim

Awesome website!

I earn my income on commission and am often entertaining clients, paying for coffee at meetings and lunches, client gifts etc - all part of the relationship building process.

Because of what I have submitted on section 4016, I have been selected for audit. I have kept all my receipts for client entertainment. Can I just submit these receipts and what are the limits here?

Also I have also claimed for bank charges and client production costs. Is this within the boundaries of 'expenses incurred in the production of income?'...

  Written by Marc

As far as I know the person who did my tax clearance certificate for the first time does no longer exist, then SARS says he must release the file, is that true?
And the person I sent to renew it says he's already made a payment, is it possible to make a payment while the file is closed?

Are donations received from various individuals taxable?

  Written by Marc

I do voluntary work in poor communities after quitting my job a few years ago. Various people knows this and are paying money into my account as donations. Is this money taxable in my hands?

The amounts varies between R20,000 - R30,000 p.m. I do not know all of my supporters as a lot of them stays anonymous and just put 'donation' on the bank reference.

Most of the amounts are paid to me this way on a month-to-month basis and the biggest amount is R6,000 p.m. I am not offer...

I need help with declaring income from admob.
I've been developing apps and have recently been receiving a good income stream from admob, paid to me via PayPal.
Would it be better to register a company?
Or should I continue receiving the money in a personal capacity?

Notice of Objection via efiling

  Written by Marc

I want to dispute the outcome of an assessment. I am using SARS efiling. I completed the form, but when I try to file it, I get errors about mandatory data. But this relates to the 'Particulars of representative' section. I don't have a representative - I'm dealing with this on my own.
What am I supposed to fill in?

Also, all my supporting documentation has already been submitted for the assessment. Do I have to resubmit the same documentation again for the dispute?

Was I qualified to pay tax return in 2007-2008?

  Written by Marc

I never submitted my tax return for 2007-2008. At that time, I was earning R69000 per annum. Also the tax return was done manually and unfortunately I can't find any copy. Now in 2012, SARS wants me to pay R8000 penalty.

My questions are:

1: was I qualified to pay my tax return?
2: What must do to dispute this penalty as I am not earning much currently?

Thanks in advance for your advice.
Ps: I am a permanent resident(SA).

How to submit a dispute after IT34 notice

  Written by Marc

I am a medical doctor working in a state hospital. I get an IRP5 from Western Cape department of Health. I also earned R12 020 in the last year doing private locums which I have declared. I understand that I will have to pay tax on this amount and have made provisions for this. When I received my IT34, it says I owe R11000 (almost as much as I earned in total). I usually get money back on my returns (from medical aid, income protection and retirement annuity) so I don't know how they calculat...

Capital gains tax on shares sold

  Written by Marc

Hi, In the current tax year I sold shares in my 3 year old business to my other shareholder. The shareholder transferred the agreed amount via an attorney (they subtracted their fees related to this transaction) to my account. The nett amount was in the low millions and I expect the full amount to be subject to CGT.

What kind of documentation do I have to provide SARS with and what kind of documentation should I keep should I ever be audited by SARS? Which amount do I record in my return?...

Tax claim for medical expenses

  Written by Marc

Hi Tim

I had to get two hearing aids but the medical aid only paid for one. I was told that I can claim the cost for the other one from tax but if I use the e-filing calculator it seems as if I will only get R5000 back of the R15000 I paid. Is that possible or how do I claim the full amount?

ITR12 and Provisional Tax, how does it all work?

  Written by Marc

Hi Tim, I am registered as a provisional tax payer as I run a sole prop but I am also registered for PAYE as I am employed by a CC I am a member of and I draw a salary. The ITR12 takes into consideration only the PAYE and UIF paid but not the provisional tax paid. Will SARS make the connection that the amount showing as owed on the ITR12 for the provisional tax has already been paid when I submitted my IRP6's? The amounts are correct (what the ITR12 says I owe and what I actually paid as provisi...

Two of my stepchildren have brain irregularities, one Dandy Walker syndrome, the other Landau Kleffner Syndrome. I have never claimed for any medical or other expenses ito these two children which are dependants on my medical aid. However when the one with DW Syndrome turned 21 I had to go through the motions of proving his dependance to keep him as adult dependant on my MA.
