I am a South African citizen who has been living overseas for several years. I left South Africa before registering for a Tax File Number and I have never lodged a return there. I have been working overseas and paying tax over here to the tax office. My question is, should I have been lodging tax returns in South Africa for all these years? Are there penalties or fines for not lodging a tax return for all this time in my case or will I be able to go through the 'formal emigration' proc...

I've did some freelance web design and development in the last tax year and so now have to declare it on eFiling. No IRP5's or anything formal like that, so I've added it under Local Business, Trade and Professional Income. My problem is that I don't know what source code to use. eFiling gives a pop-up that allows you to select something, but nothing relates to website development (I'm not even sure what Trade Section to use). The list of source codes on SARS website also turned up nothing.

I lived in a property for a number of years, then rented it out for a few more years after that, and I have now sold the property. It appears that CGT is only applicable to the pro-rata portion of the time that the property was rented out - thanks for the blogs and answers to previous questions on your site I was able to figure that one out. My problem is how to capture this in efiling. Do I pro-rata the base cost and proceeds and enter the reduced amounts? Or do I tick that it is a gain in lieu...

Hi Tim. I have a major dispute going on with SARS as efiling didn't show that my return for 2007 was done manually. Being a new efiling user I was still learning the process. How can SARS be so inhumane when they have clearly made this service available to the common person and then charge us thousands for making a human error by clicking a wrong button. I am an independent contractor operating out of a home office, and earned commission during the year from two sources, however only one of them deducted PAYE. That IRP5 is reflected on eFiling, however there is no section on the ITR12 to declare the second source of commission income. We have a Company based in South-Africa but all the work (professional engineering services) we do is for a Company Based in Tanzania. At the end of each service provided to this company we Invoice them and when they pay us they deduct 15% Withholding tax. I have a daughter who is deaf she has finished Matric at a school for the deaf she now attends a normal colledge because there are no specialised colledges for deaf students.
I understand that I cannot claim for her fees because it is a College however I did put in a claim in 2014 for travelling because she cannot use public transport to commute to college because of her lack of communication and hearing, but my claim was rejected.
I see the tax act uses the word Specialised School but makes no mention for college or university ...
