SARS is requesting that my husband submit a 2007 tax return. However, he was only working certain times during that tax period (as a freelance contractor) and has no IRP5. He contacted the company he worked for as well, and they have no record of a IRP5 as well. What do you advise him to do now if he has no documents for that tax period? He may be able to get a record of his retirement annuity contributions, but that is all.

He needs to go to the police station and swear an affidavit and basically give reasons as to why he is unable to produce the required documents.

He can take this affidavit to SARS together with any other records he may have to prove his earnings for this year eg. bank statements, invoices etc

Thank your very much for your quick reply. I forgot to mention that he does not have the invoices for that period anymore and has since moved twice and also switched banks during that time, thus he has no bank statement as well.

Does he have to go in to SARS or can he solve this via efiling? I have heard that one can submit a nil-return in this case, if you are able to provide an affidavit if requested by SARS. Is this true?

By submitting a nil Tax Return, he is declaring that he earned nil income for the year which could be untrue.
It would be better for him to get the affidavit (including the explanation about the invoices and the bank statements) and take it to SARS and ask them to advise what to do further.
