I was dismissed 2014 . On my dismissal in 2014 I forfeited 14 days annual leave as the maximum the company would pay is up to 40 days. Can I claim the loss of the leave from SARS ? I did pay tax on the 40 days that I was paid out by the company.

No, unfortunately you cannot. A normal leave payout is included in your income and would be taxed the same as your salary. However, if you had to forfeit leave due to your company's leave policy, this would have no tax consequence.
