No, the deceased estate would have to claim this in their final tax return submitted.

hi there is no estate for deceased as he did not have any assets can I still claim for medical aid tax return the deceased had 3 dependents including himself

The executor of his estate will have to do a final tax return to the date of his death, the medical aid can be claimed as part of that. Thereafter no medical aid can be claimed as he is no longer the member on the fund.
