Supporting documents - what if they are not submitted on time? I uploaded and forgot to submit?



Hi Tim, great website and good gen. SARS phoned me asking for a schedule of my deductions. I uploaded it and forgot to click on 'submit', then received a second assessment disallowing the deductions - probably because I didn't submit the document.

What do you suggest? If I lodge a notice of objection, will they allow the late submission of the document? How much should I explain to them - fall on their mercy regarding my mistake, or just assert that I am entitled to the deductions?

If you lodge an objection it can become complicated and take awhile to be resolved. If you are able to and have the time it would be best to go into a SARS office and explain what has happened and that you wish to submit the schedule now and will they still take it into account. Did they impose any penalties on you?

If that doesn't work then you should lodge a dispute and go the formal route.

Hi Tim, thanks for the advice so far, I will try the SARS office.
I phoned the SARS help line but the person on the other end said I should not explain my mistake on the dispute form as it goes to the Legal department and simply assert that I am entitled to the deductions. However she gave me some other incorrect information so I don't want to make things worse. The penalty is a few Rands for underpaying provisional tax based on the second assessment.

You are entitled to the deductions, you just returned the form late. It could be wiser to just submit them with the dispute forms and push for them to be allowed. I thought you meant to assert yourself at SARS when you are there.

Tim, based on this I have resubmitted the dispute with a motivation that I had uploaded the document but I didn't realise it wasn't submitted.
As it was, I had difficulty getting my supporting documents to actually submit this time because of their website functionality.

The incorrect info she gave me was regarding my first dispute which was rejected because of an incorrect source code. She gave me another one but got her figures mixed up. I picked that up when I double-checked. She also argued with me about claiming depreciation and wouldn't listen to my explanation of my pay structure. Anyway it's in now - hope for the best - will let you know the outcome. Many thanks!

The best is to convert the documents into .pdf which is less than 1.8mb per file, but I agree it is not the easiest site to upload documents to.

The call centre assistants are not the final word on tax matters and you should include all the relevant information in your dispute form including all the amounts and supporting documents you wish to submit .

Good news - SARS allowed my objection and took my late submitted schedule into account, so my assessment was restored to the original figure.
